FIR Filed Against TMC MP Mahua Moitra for Remarks on NCW Chief

MAhua Moitra FIR Hathras incident

Delhi Police have registered an FIR against Trinamool Congress (TMC) parliamentarian Mahua Moitra following a controversial social media post about National Commission for Women (NCW) chairperson Rekha Sharma. The FIR was filed under Section 79 of the newly-enacted Bharatiya Nyaya Sanhita (BNS), which replaced the Indian Penal Code (IPC) on July 1. The complaint was lodged by Rekha Sharma herself.

The incident that sparked the controversy occurred during Sharma’s visit to Hathras, Uttar Pradesh, in the wake of a tragic stampede at a religious event that resulted in 121 fatalities. A video surfaced showing Sharma walking while someone behind her held an umbrella, which many perceived as insensitive given the context of her visit.

Mahua Moitra reacted to the video with a tweet saying, “She is too busy holding up her boss’s pajamas,” which was perceived as derogatory. This prompted the NCW to condemn Moitra’s remark, labeling it as “crude and outrageous” and a violation of a woman’s right to dignity.

In response to Moitra’s comment, the NCW invoked Section 79 of the Bharatiya Nyay Sanhita, 2023, and called for legal action. The Delhi Police acted on this by filing an FIR. Moitra, however, remained defiant, challenging the authorities to take immediate action against her. She posted, “(I) Am in Nadia in case you need me in the next 3 days to make a quick arrest. I Can Hold My Own Umbrella,” signifying her readiness to face any consequences.

The incident has sparked a wide range of reactions, with the Bharatiya Janata Party (BJP) condemning Moitra’s remarks as indecent and shameful. The exchange has further intensified the ongoing political discourse and highlights the sensitive nature of public comments made by political figures.

This incident underscores the importance of respectful discourse, especially when addressing public figures and sensitive situations. It also reflects the evolving legal framework in India, with the newly implemented Bharatiya Nyaya Sanhita being put to immediate use. The outcome of this legal battle will be closely watched as it may set a precedent for future cases of similar nature.
